Our client was charged with an underage DUI, open container, reckless operation and driving without a license. The Judge granted a motion to suppress evidence finding that the breath test results were inadmissible because our client was not properly advised of his statutory rights relating to the chemical testing due to a clear language barrier and therefore could not make a knowing and intelligent waiver of those rights. Charges were reduced to an open container, reckless operation and driving without a license.
