Did you lose the 2023 H-1B via lottery? You may get a second chance!
USCIS has completed this second selection process, and those with selected registrations will have their myUSCIS accounts updated to include a selection notice, which includes details of when and where to file.
If you are selected in this second lottery round, it does not mean that you will automatically be granted an H-1B visa, as evidenced by this new availability. You must still submit a competent petition demonstrating to USCIS that you meet all of the qualifications required for an H-1B visa.
Specifically, you must demonstrate that:
- the position is a specialty occupation and
- the foreign national meets all the required criteria.
It is important to remember that in addition to meeting these qualifications, USCIS requires you to demonstrate such in your application. That is why it is important to have an experienced H-1B visa attorney to assist you.
